These Terms of Service ("Terms") govern your access to and use of the Breach Guardian mobile application and the Breach Guardian web dashboard (collectively, the "Service") operated by SecurityIndeed, a product of Reddy LLC ("we," "us," or "our"). By downloading, installing, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
IMPORTANT: These Terms contain a binding arbitration clause and a class action waiver (Sections 12 and 13) that affect your legal rights. Please read them carefully.
1. Description of Service
Breach Guardian provides two components: (a) a mobile application that performs on-device AI scanning of SMS and email messages to detect phishing, spam, and social engineering attempts, and (b) a web dashboard that provides breach monitoring via the Have I Been Pwned API and automated data broker removal via a third-party scrubbing provider. The mobile app and web dashboard are separate products that can be used independently or together.
2. Eligibility
You must be at least 13 years old (16 in the EEA, UK, or Switzerland) to use the Service. If you are under the age of majority in your jurisdiction, you must have permission from a parent or legal guardian to use the Service. By using the Service, you represent that you meet these requirements.
3. Account Registration
The mobile app does not require an account — it operates entirely on your device with no server communication. The web dashboard requires an account. You are responsible for safeguarding your password and for all activities that occur under your account. You must notify us immediately of any unauthorized use. We are not liable for any loss or damage arising from your failure to maintain account security.
4. License and Restrictions
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal, non-commercial use. You may not:
- Reverse engineer, decompile, or disassemble the Service except as permitted by applicable law
- Modify, create derivative works of, or redistribute the Service
- Use the Service for any illegal, fraudulent, or unauthorized purpose
- Use the Service to violate the rights of any third party
- Attempt to gain unauthorized access to our systems or other users' accounts
- Use automated systems (bots, scrapers, etc.) to access the Service in a manner that imposes an unreasonable load
5. Device Permissions and SMS Access
The mobile app requires SMS read permission (on Android) solely to scan messages locally on your device for spam and phishing threats. This permission is used exclusively for local scanning. The app does not transmit SMS content, does not share it with any third party, and does not use it for any purpose other than providing the threat-detection functionality. You can revoke SMS permission at any time through your device settings; the app will continue to function for other features.
6. Acceptable Use
You agree not to use the Service to transmit any malicious code, to harass or threaten others, to infringe intellectual property rights, or to engage in any activity that violates applicable law. We reserve the right to suspend or terminate accounts that violate these Terms.
7. No Guarantee of Threat Detection
The Service is provided as a tool to help identify potential threats, not as a guarantee against them. No threat-detection system is perfect. Our AI models may fail to detect some threats (false negatives) or may incorrectly flag safe content (false positives). You must exercise your own judgment and not rely solely on the Service to protect you from phishing, scams, or other threats.
Similarly, breach monitoring depends on publicly available breach data and may not reflect all breaches. Data broker removal is processed through third-party APIs; we cannot guarantee that all data will be removed from all broker sites.
8. Assumption of Risk
You acknowledge and agree that your use of the Service is at your sole risk. You are responsible for any decisions you make or actions you take based on information provided by the Service.
9. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE. We do not warrant that the Service will be uninterrupted, timely, secure, or error-free, or that defects will be corrected. To the maximum extent permitted by applicable law, we disclaim all warranties.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL SECURITYINDEED, REDDY LLC, OR ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (a) YOUR USE OR INABILITY TO USE THE SERVICE; (b) UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS OR DATA; (c) ANY THIRD-PARTY CONTENT OR CONDUCT ON THE SERVICE; OR (d) ANY OTHER MATTER RELATING TO THE SERVICE. OUR AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE SHALL NOT EXCEED THE GREATER OF (i) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (ii) USD $100.
11. Indemnification
You agree to defend, indemnify, and hold harmless SecurityIndeed, Reddy LLC, and its affiliates from and against any claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney's fees) arising from: (a) your use of and access to the Service; (b) your violation of any term of these Terms; or (c) your violation of any third-party right, including any intellectual property or privacy right.
12. Dispute Resolution and Arbitration
Any dispute arising out of or relating to these Terms or the Service shall first be resolved through good-faith negotiation. If the dispute cannot be resolved through negotiation within 60 days, it shall be resolved by binding individual arbitration under the Commercial Arbitration Rules of the American Arbitration Association, rather than in court, except that you may assert claims in small claims court if your claims qualify. The arbitration shall take place in the State of Minnesota unless otherwise agreed.
Opt-out: You may opt out of this arbitration agreement within 30 days of first accepting these Terms by emailing support@securityindeed.org with the subject "Arbitration Opt-Out."
13. Class Action Waiver
YOU AND SECURITYINDEED AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. Unless both you and we agree otherwise, the arbitrator may not consolidate more than one person's claims, and may not otherwise preside over any form of a representative or class proceeding.
14. Intellectual Property
The Service and its original content, features, and functionality are and will remain the exclusive property of SecurityIndeed and Reddy LLC. The Service is protected by copyright, trademark, and other laws of the United States and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.
15. Third-Party Services and Content
The Service integrates with third-party services including Have I Been Pwned and a vendor-agnostic data scrubbing provider. We are not responsible for the content, privacy policies, or practices of any third-party services. You acknowledge and agree that we shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of any such content, goods, or services available on or through any such third-party services.
16. Service Modifications
We reserve the right to modify or discontinue, temporarily or permanently, the Service (or any part thereof) with or without notice. We shall not be liable to you or to any third party for any modification, suspension, or discontinuance of the Service.
17. Termination
You may terminate your account at any time by deleting the mobile app or requesting account deletion for the web dashboard. We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of these Terms.
18. No Emergency Services
THE SERVICE IS NOT A SUBSTITUTE FOR EMERGENCY SERVICES. If you believe you are the victim of an active scam, identity theft, or fraud, contact law enforcement, your financial institution, or appropriate emergency services immediately. Do not rely on the Service as your sole means of responding to an active security incident.
19. Governing Law
These Terms shall be governed and construed in accordance with the laws of the State of Minnesota, United States, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
20. Modifications to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
